RIGHTS OF IMMIGRANT STUDENTS

• Can public schools deny a free public education to students based on their immigrant status? No. The Equal Protection Clause of the U.S. Constitution states: “No State shall … deny to any person within its jurisdiction the equal protection of the laws.”  In Plyler v. Doe, 457 U.S. 202 (1982), the U.S. Supreme Court held that the Equal Protection Clause bars the government from denying a free public education to students who were not “legally admitted” to the United States. As a result, public schools must treat immigrant students and non-immigrant students equally.
• What rationale did the Supreme Court provide for its decision in Plyler? The Supreme Court explained that holding undocumented immigrant children accountable for their parents’ actions “does not comport with fundamental conceptions of justice.” Plyer, 457 at 220. Additionally, denying innocent children access to a public education, “imposes a lifetime hardship on a discrete class of children not accountable for their disabling status. By denying these children a basic education, we deny them the ability to live within the structure of our civic institutions, and foreclose any realistic possibility that they will contribute in even the smallest way to the progress of our Nation.” Id. at 223. 
• What precautions should school districts take in light of Plyler? School districts should not take actions that could reasonably be perceived as discouraging undocumented immigrants from attending school. For example, school districts should not ask about a family’s immigration status during the enrollment process and should not maintain records about a family’s immigration status. 

ICE ACCESS TO DATA ON STUDENTS OR PARENTS

• What is ICE? ICE is an acronym that stands for Immigration and Customs Enforcement. 
• What should staff do if an ICE agent serves a subpoena for student records? Teachers should notify the building administrator. In turn, the building administrator should notify the Superintendent’s office, so the subpoena can be reviewed by the District’s legal counsel. Do NOT immediately provide records in response to a subpoena. To be effective, a subpoena for records must be personally served on the records custodian and must include prepayment for the cost of producing the records. Additionally, in most cases, the Family Educational Rights Privacy Act (FERPA) requires school districts to notify parents of a subpoena before complying with the subpoena. 
• What should staff do if ICE presents a subpoena for student records and demands immediate compliance? Teachers should notify the building administrator. In turn, the building administrator should notify the Superintendent’s office. With very limited exceptions, the law does not require, or allow an administrative agency to demand, immediate compliance with a subpoena. 
• What is “directory information”? The term “directory information” refers to information contained in an education record of a student that would not generally be considered harmful or an invasion of privacy if disclosed. School districts may designate innocuous educational data as public directory information. Common examples of directory information include a student’s name, photo, school attended, grade, participation in officially recognized activities and sports, awards, honors, and date of graduation. In Minnesota, school districts may not designate any personal contact information on a student as directory information. Additionally, protected class status—including race, national origin, or immigrant status—is not directory information. Finally, parents (or students who are 18) can “opt out” of having any information on their child designated as directory information. 
• What should staff do if ICE requests or demands “directory information” on a student? Teachers should notify the building administrator. In turn, the building administrator should notify the Superintendent’s office. The District needs to verify that the information being requested is, in fact, “directory information” and that the parents have not opted out of having the information designated as “directory information.” As a result of recent legislative amendments, personal contact information on students or parents may no longer be designated as directory information.
• What should staff do if ICE requests or demands information about a student’s parent(s)? Teachers should notify the building administrator. In turn, the building administrator should notify the Superintendent’s office. Minnesota law classifies data on parents as private data on individuals. Therefore, unless the data on parents have been properly designated as “directory information,” the District may not release data on parents. 

ICE ACCESS TO STUDENTS AT SCHOOL

• What should staff do if ICE enters the school building and demands to speak to a student? Teachers should notify the building administrator. In turn, the building administrator should notify the Superintendent’s office. Without an arrest warrant or court order, ICE does not have the authority to demand access to a student at school. Additionally, District policy generally prohibits outside agencies, including law enforcement agencies, from interviewing students on school property without parental consent, unless a health or safety emergency or other exigent circumstance exists.  
• What should staff do if ICE enters the school building and presents and “administrative warrant” to speak to a student? Teachers should notify the building administrator. In turn, the building administrator should notify the Superintendent’s office, so the Superintendent’s office can contact the District’s legal counsel. An administrative warrant may or may not be enforceable. 
• What should staff do if ICE enters the school building and presents a “judicial warrant” to speak to a student or to remove a student from school property? A judicial warrant or court order must be signed by a federal or state court judge. An arrest warrant is an example of a judicial warrant. School districts must comply with a judicial warrant. The Superintendent’s office should be notified immediately of any judicial warrant that is served on a District employee. The building administrator may ask, but may not require, ICE officials to execute the warrant outside of school. 
• If ICE presents a judicial warrant to remove a student from school, may a District employee accompany the student with ICE until the student’s parent shows up? No. District employees do not have any authority to accompany a student who is being arrested or detained, nor would ICE permit this. 

ICE ACCESS TO STUDENTS ON SCHOOL BUSSES

• May ICE agents enter a school bus or remove a student from a school bus? ICE agents may not enter a school bus without a court order or judicial warrant.
• What should a bus driver do if ICE enters the bus and presents a warrant or court order to remove a student from the bus? Bus drivers should notify the Director of Transportation. In turn, the Director of Transportation should notify the Superintendent’s office, so the Superintendent’s office can contact the District’s legal counsel. Meanwhile, the bus driver should not try to physically block ICE agents
• What should a bus driver do if the driver sees ICE agents at a bus stop?  On the one hand, employees may not take actions to “evade” ICE agents or impede their work. On the other hand, a bus driver should not require any student to get off the bus if the student feels unsafe for any reason.  If the bus driver determines that stopping for any reason (not specific to ICE) will present a risk of harm to students or will create a material and substantial disruption to the transportation of students, the driver may continue the route without stopping and immediately radio a supervisor.

ICE ACCESS TO SCHOOL PROPERTY

• Do ICE agents have greater rights to access school property than members of the public?  No. School districts should treat ICE agents the same as other members of the public. ICE agents need a warrant or court order to enter onto any area of District property where members of the general public are not permitted.  The following are examples:
  • Like members of the public, ICE agents may enter the main office, but they may not loiter there. If ICE agents enter the office and do not present an arrest warrant or court order, the principal should politely ask the agents to leave school property.
  • Like members of the public, ICE agents may not loiter in the entryway of a school.
  • Like members of the public, ICE agents may not loiter in school parking lots.
  • Like members of the public, ICE agents may drive through a school parking lot.
  • Like members of the public, ICE agents are allowed to attend various sporting events and performances, provided they pay any applicable fee.
• May a school district prohibit ICE agents from entering onto school property if the District can reasonably forecast that the presence of ICE agents will create a material and substantial disruption?  If the school district can reasonably forecast that the presence of ICE agents will create a material and substantial disruption to school operations, the district may arguably prevent ICE agents from entering onto school property unless the ICE agents have a warrant or court order.

WHAT IS THE ROLE OF SCHOOL STAFF WHEN ICE TAKES ACTION?

• If ICE detains a student’s parents, may a staff member “take in” the student and provide room and board to the student until the parents are released or another relative is identified? No. District employees do not have any authority to assume the role of a legal guardian or to assume physical custody of a child.
• What role should District employees play in any type of immigration action towards a district student or family? In the event that ICE becomes involved in an action with a student or family, District employees should not seek to interfere, to provide advice on how to evade ICE, or to provide legal advice. However, employees may provide local resources to students and families and may help families connect with local resources, similar to the manner in which schools assist families with food or housing insecurities.
• May staff members inform parents that ICE came to school and requested information about them or about their child? Yes, unless the District has received a court order or grand jury subpoena prohibiting the District from disclosing information.
• If ICE detains a student’s parents and the student does not have any other emergency contacts listed, what should the District do? If the District does not know of any other close relatives, the District must contact social services.

CAP Agency coordinates various social services for Scott County residents including childcare resource and referral, crisis nursery, food shelf, thrift store, housing assistance, WIC program, and heat/energy assistance programs. Call the Shakopee office at 952-496-2125.

Law Help MN helps low income people with a broad range of civil (non-criminal) legal matters. The website provides information and resources on a variety of legal topics and can help connect individuals to legal aid and assistance. Live online chat is also available. 

Scott County Legal Clinic

Southern Minnesota Regional Legal Services provides volunteer attorneys in Scott county for occasional clinics held at the Public Library, 235 Lewis Street South in Shakopee. Attorneys will meet with clients with legal issues related to: debt collection, probate, guardianship, nursing home issues, landlord/tenant issues and employment law. Scott County Law Library

Provides free clinics for low income individuals (those who fall 300% below the 2011 Federal Poverty Guidelines) on legal matters such as divorce and civil issues. The clinic provides workshops at the Scott County Law Library which is located at the Scott County Government Center. Call the law library for more information at 952-496-8713.

Scott County families are invited to visit a Family Resource Center for information about community resources, referrals for services or assistance completing applications and paperwork. Attend a free and fun family programs and parenting supports throughout the month. Opportunities are available to connect with providers individually. They also offer culturally specific support and language access for Latino and Somali participants. Services are free and confidential.

Southern Valley Alliance is a non-profit organization dedicated to providing victims of domestic violence and their families with support, referrals, protection and advocacy. They proudly serve Carver and Scott counties in Minnesota.

No clinics on legal holidays. The clinic serves uninsured children and adults as well as those individuals who have out-of-pocket expenses for vaccines).

Mobile Clinics: Rotating locations in Jordan (Radermacher Fresh Market), Savage (Scott County Library) and Shakopee (Slavic Baptist Church, 1205 10th Avenue  AND  Valley Green Workforce Center, 792 Canterbury Road South in Suite B231).  The mobile clinics provide care for short term and ongoing health concerns; health screenings (cholesterol tests, blood pressure and blood glucose tests); assistance with obtaining affordable prescription medication; and information/referral to affordable health care and other community resources.  Services are FREE for uninsured and underinsured residents of Scott County. Shakopee Public Utilities will connect with any person or family to set up a payment plan that allows temporary relief due to an interruption of employment. Click here for more info.

In addition to heat resources noted above, Heart and the CAP Agency have created a system where any requests for rent or utility assistance can be directed to all Shakopee Public Schools Social Workers. A team, managed by these community partners, are able to answer calls 24/7 for families who are facing shutoffs or the heavy burden of an insurmountable bill. Through donations made by both agencies, they will work directly with families to provide direct short-term assistance. School Social Workers will work to get families connected accordingly.
